The City of Albuquerque has completed the process for adopting new rules for its Independent Hearing Office. The period for public review of these proposed rules spanned from February 6 to March 13, 2025, with notifications provided through various channels including the City Clerk’s rulemaking webpage and postings at City Hall and Plaza del Sol.
Two public hearings were conducted during this time. The first was on February 20, 2025, at 8:30 am, and the second occurred on March 13, 2025, at 9:00 am. These hearings offered an opportunity for community members to express their views on the proposed regulations.
According to ROA 1994, § 2-7-8-3(A)(1), “The City Clerk shall adopt and promulgate rules pertaining to administrative hearings.” The intention behind these new rules is to ensure fairness and consistency in proceedings, enhance transparency, build trust among participants, promote efficiency in processes, facilitate compliance with established norms, and protect the rights of all parties involved.
A report summarizing public comments and recommendations has been prepared for review by the Chief Administrative Officer (CAO). This document provides a detailed account of the feedback received during the rulemaking process.
The Office of the City Clerk has conducted this rulemaking in line with ROA 1994 §2-15-1. After reviewing public input and making necessary amendments, it recommends that the proposed rules be adopted as amended.
