An Alamogordo man, Jonah Apodaca, has been sentenced to six years in federal prison for his role in providing a modified shotgun used in the fatal shooting of an Alamogordo Police Officer. The incident took place on July 16, 2023, and resulted in the death of Officer Anthony Ferguson.
Court documents reveal that Apodaca, aged 31, supplied a "sawed-off" shotgun to Dominic Cruz De La O. DNA evidence from Apodaca was found on the shotgun shell and ammunition retrieved from the weapon's chamber and magazine tube.
Following his prison term, Apodaca will undergo three years of supervised release. There is no parole option available in the federal system.
Dominic Cruz De La O faces charges related to possession of an unregistered firearm and a firearm without a serial number. He remains detained as he awaits trial set for February 26, 2025.
The announcement was made by U.S. Attorney Alexander M.M. Uballez alongside Brendan Iber, Special Agent in Charge of the Phoenix Field Division of the Bureau of Alcohol, Tobacco, Firearms and Explosives.
The investigation involved collaboration between multiple agencies including the Bureau of Alcohol, Tobacco, Firearms and Explosives, Alamogordo Police Department, New Mexico State Police, and Otero County Sheriff’s Office. Assistant U.S. Attorneys Maria Y. Armijo and Ry Ellison are handling prosecution duties for this case.
